Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of Clapscape. By creating an account or using the platform, you agree to be bound by them. If you're using Clapscape on behalf of a business, you're confirming you have the authority to accept these Terms on its behalf.

2. What Clapscape Is

Clapscape is a marketplace that connects travelers with tour operators, agents, guides, drivers and other freelance travel professionals. We provide the platform for discovery, bidding, booking and payment — we are not a travel agency, and we are not a party to the trip itself.

The actual travel service is a direct arrangement between the traveler and the agent, guide or driver they book. Clapscape is not responsible for the conduct, quality, safety, or legality of the service provided by either side.

3. Accounts & Eligibility

You must be at least 18 years old to create an account.
You're responsible for keeping your login credentials confidential and for all activity under your account.
You agree to provide accurate information when registering and to keep it up to date.
We may suspend or terminate an account that provides false information or violates these Terms.

4. Verification of Agents, Guides & Drivers

Agents, guides and drivers must submit identity and license or business registration documents before they can list on Clapscape. A "verified" badge means our team has reviewed those documents — it is not a guarantee of the quality of the service provided, and travelers should still use their own judgment before booking.

5. Bidding & Bookings

Travelers can post a trip request with their dates, route and budget, and verified agents, guides or drivers may submit bids.
Bid amounts and bidder ratings are visible to the traveler, who chooses freely who to book.
A booking is only confirmed once a traveler accepts a bid (or books a fixed-price package) and payment is made. At that point, a direct contract for the trip exists between the traveler and the provider — Clapscape is not a party to it.
Providers may decline to bid on a request, but once a bid is accepted, cancelling is subject to Section 6.

6. Payments, Fees & Cancellations

Payment is made in-app at the time of booking and is held until the trip is confirmed as completed by both sides, at which point it is released to the provider.
Clapscape charges a service fee on completed bookings, deducted from the amount released to the provider. Bids that don't result in a booking are never charged.
If a provider cancels after a booking is confirmed, the traveler is notified immediately and any payment held is refunded; repeated cancellations affect a provider's search ranking.
If a traveler cancels, refund eligibility depends on how close to the trip date the cancellation is made — this will be shown before you confirm a booking.
Payments are processed by a third-party payment processor; Clapscape does not store your full card details.

7. Reviews & Ratings

Only a traveler who completed a paid booking can leave a review for that provider. We don't remove reviews just because they're negative, but you can flag a review you believe is abusive, fraudulent, or unrelated to a real booking, and we'll investigate.

8. Featured Listings & Advertising

Organic search ranking is based on reviews and response time only. Providers may pay for featured placement, which is always labeled "Featured" so travelers can tell the difference between an ad and an organically top-ranked listing.

9. Prohibited Conduct

Circumventing the platform to arrange payment or booking outside Clapscape to avoid fees.
Posting false reviews, or reviews not tied to a completed, paid booking.
Submitting false identity, license, or business documents for verification.
Harassing, threatening, or discriminating against other users.
Using the platform for any unlawful purpose.

10. Disclaimers & Limitation of Liability

Clapscape is provided "as is." We do our best to verify the agents, guides and drivers who list on the platform, but we don't guarantee the accuracy of listings, the conduct of any user, or the outcome of any trip.

To the extent permitted by law, Clapscape is not liable for indirect, incidental, or consequential damages arising from your use of the platform or from any trip booked through it. Our total liability for any claim is limited to the service fee we collected on the relevant booking.

11. Termination

You may close your account at any time. We may suspend or terminate access for violation of these Terms, fraudulent activity, or behavior that puts other users at risk.

12. Governing Law

These Terms are governed by the laws of the Kingdom of Bhutan. Any dispute arising from these Terms or your use of Clapscape will be handled in accordance with Bhutanese law.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll notify you through the platform or by email before they take effect. Continued use of Clapscape after changes take effect means you accept the updated Terms.
